Movable Type license exposed

Back in June, there was a lot of discussion about Movable Type's license terms in light of the notice Six Apart sent to Kathy Kinsley at BlogHouse, alleging that she was in violation of MT's license by offering to install Movable Type for her customers.

No one has, to my knowledge, offered any definitive evidence one way or the other as to whether certain terms in MT's licenses are legal. (My Software Licensing category explores the issues to some extent.)

I did some legal research on my own and found the answer to the question of whether those license terms are legal or not.
